US Sues Norfolk Southern to Halt Delays on Amtrak Passenger Route, Reports Reuters

WASHINGTON – The U.S. Justice Department has initiated a civil lawsuit against Norfolk Southern, accusing the transportation company of causing delays to passenger trains on Amtrak’s Crescent Route, which operates between New York City and New Orleans, in violation of federal regulations.

The Biden administration has prioritized the enhancement of passenger rail services, including high-speed rail initiatives. As part of a significant infrastructure bill passed in 2021, Congress allocated $66 billion for rail projects, with $22 billion earmarked for Amtrak and an additional $36 billion available for grants.

In response to the allegations, Norfolk Southern expressed its intention to address the concerns surrounding train delays. The company stated its commitment to comply with legal requirements and work collaboratively with relevant stakeholders.

Amtrak aims to achieve financial stability while increasing its ridership to 66 million by 2040. Between 2003 and 2019, Amtrak saw a 45% rise in passenger numbers, reaching 32.3 million.

Notably, Amtrak reported that half of the 46 states it services have limited train options. Regions such as Florida, Ohio, and Arizona, along with the Mountain West and Gulf Coast, are primarily served by long-distance trains with no more than one round trip daily.

The Crescent Route spans 1,377 miles and connects 33 towns and cities. Norfolk Southern operates 1,140 miles of rail along this route and is responsible for the dispatching of all trains, including their own freight operations.

Amtrak’s CEO, Stephen Gardner, commended the Justice Department’s lawsuit, stating it would contribute to ensuring timely arrivals for passengers.

According to the Justice Department, approximately 266,000 travelers used the Crescent Route last year, but only 24% of southbound trains on Norfolk Southern-managed tracks reached their destinations on schedule.

Federal law stipulates that Norfolk Southern must prioritize Amtrak passenger trains over freight trains. However, the Justice Department claims that Norfolk Southern persistently fails to adhere to this requirement, resulting in significant delays that inconvenience travelers, negatively impact Amtrak’s financial situation, and obstruct passenger rail services.

“Americans should not face travel delays due to violations by rail carriers,” stated Attorney General Merrick Garland.

Transportation Secretary Pete Buttigieg remarked that compliance with this crucial law has been inconsistent over the past 50 years, despite federal mandates requiring freight rail companies to prioritize Amtrak passenger services on shared tracks.
