US Navy Secretary Violated Law on Political Activity, Oversight Agency Reports
U.S. Navy Secretary Faces Scrutiny Over Political Comments
WASHINGTON – Secretary of the Navy Carlos Del Toro reportedly breached a federal law that restricts political activities for government employees by openly supporting President Joe Biden and criticizing former President Donald Trump, according to a statement from the Office of Special Counsel on Thursday.
Federal employees in the U.S. are governed by the Hatch Act, which aims to prevent partisan influence within the government. This law prohibits the use of official authority to sway election outcomes.
During an official trip to London in January 2024, Del Toro expressed confidence in the American public’s support for Biden’s re-election, stating, "I am confident that the American people will step up to the plate come November and support President Biden for a second term as our Commander-in-Chief."
Further, the Office of Special Counsel noted that Del Toro also articulated his opposition to Trump in an interview with the BBC on the same day.
Special Counsel Hampton Dellinger remarked, “In his official capacity on a taxpayer-funded trip, Secretary Del Toro encouraged support for one candidate over another in the upcoming presidential election.” He added that Del Toro’s actions constituted a violation of the Hatch Act and emphasized the concern given Del Toro’s acknowledgment that military affairs should remain separate from partisan politics.
Del Toro self-reported his remarks to the agency, stating his aim was to highlight the significance of international alliances. He later acknowledged, “In retrospect, I believe my response should have been delivered more broadly without reference to specific candidates.”
The U.S. military is designed to be nonpartisan, committed to the Constitution, and independent of political affiliations. Del Toro holds the position of Navy Secretary, a civilian role appointed by President Biden.
Possible consequences for the violation could include a fine or removal from office. The Pentagon confirmed it is reviewing the situation, reiterating the importance of maintaining a nonpolitical stance within the military.
